Psychostrategist, LLC ("we," "us," or "our") is a Wyoming-based company that provides various digital products, including but not limited to e-books, online courses, software, and downloadable content (collectively referred to as "Digital Products"). This Terms of Service ("Terms") outlines the terms and conditions regarding the use of our website, the purchase of our Digital Products, and our refund policies.

By visiting our website, purchasing any Digital Product from Psychostrategist, or using our services, you ("Customer," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these terms, please do not use our website or purchase our Digital Products.

3.1 Types of Digital Product Sales We offer Digital Products under the following conditions: a) Preorder for download on an estimated date b) Immediate download c) Immediate download + book print with shipping (where applicable)

3.2 Preorders Preorders for Digital Products cannot be cancelled or refunded. By placing a preorder, you agree to purchase the Digital Product on the estimated release date.

3.3 Immediate Downloads Immediate download products will be delivered to you promptly after purchase, as described in Section 4.

3.4 Book Prints Where offered, physical book prints will be shipped to the address provided at the time of purchase. Book prints ship by the estimated shipping date displayed on the product page. Shipping costs and book prints are non-refundable.

4.1 Digital Products will be delivered to the email address provided by you at the time of purchase.

4.2 Delivery is considered complete when the Digital Product has been sent to the email address you provided, regardless of whether you actually receive or open the email.

4.3 It is your responsibility to ensure that the email address you provide is correct and that your email settings allow for the receipt of emails from our domain.

4.4 If you have not received your Digital Product within 24 hours of purchase or before the estimated availability date, you must contact us at hello@psychostrategist.com. Failure to notify us within this timeframe will result in the forfeiture of any potential resolution.

5.1 General No-Refund Policy Unless explicitly stated otherwise for specific products, all sales of Digital Products are final. Once a Digital Product has been delivered to you via email or any other electronic means, NO REFUNDS will be issued under any circumstances.

5.2 Exceptions to No-Refund Policy Certain Digital Products may be eligible for our Money-Back Guarantee, as outlined in Section 6. This guarantee applies only to products explicitly marketed as having this guarantee.

5.3 Non-Refundable Circumstances Refunds will not be issued for: a) Dissatisfaction with the product b) Accidental purchases c) Change of mind d) Financial hardship e) Technical issues on the customer's end f) Claims of not receiving the product (subject to Section 4.4)

6.1 Eligibility Only Digital Products explicitly marketed as having a Money-Back Guarantee are eligible for refunds under this section. The guarantee period is 100 days from the date of purchase, unless otherwise specified in the product description. Physical products are non-refundable. If physical products are purchased as part of a digital and physical product bundle, then the price difference for the physical product add-on is non-refundable.

6.2 Conditions for Refund To be eligible for a refund under the Money-Back Guarantee, you MUST meet ALL of the following criteria within the specified guarantee period:

a) Provide proof of purchase of the eligible Digital Product. b) Demonstrate that you have genuinely applied the techniques outlined in the Digital Product for the full guarantee period. c) Provide a detailed account of how you've implemented these techniques and why you believe you haven't gained the expected benefits. d) Submit a written statement explaining why you feel you haven't achieved the promised results as described in the product marketing materials.

6.3 Refund Request Process a) You must submit your refund request within the specified guarantee period. For example, if you purchased a product with a 100-day guarantee on March 1, 2024, your refund request must be submitted within 100 days of March 1st. b) No refund requests will be considered after the guarantee period has expired. c) Submit your refund request to hello@psychostrategist.com with the subject line "Refund Request - [Your Order Number]". d) Include all required documentation and explanations as outlined in Section 6.2.

6.4 Assessment and Processing a) We will assess all refund claims within 14 days of receiving all required evidence. b) We reserve the right to verify all refund claims and request additional information if necessary. c) We have sole discretion in determining if eligibility requirements have been met. d) We reserve the right to disqualify fraudulent or misleading claims. e) Approved refunds will be processed within 14 days of approval.

6.5 Terms of Refund If your refund request is approved: a) We will refund the full purchase price of the eligible Digital Product. b) You will be allowed to keep the entire product (Digital Product and any associated materials).

7.1 You are solely responsible for reviewing the product description, system requirements, and any other relevant information before making a purchase.

7.2 It is your responsibility to ensure that your device and technical setup are compatible with our Digital Products before making a purchase.

7.3 You agree to make an informed decision before purchasing any Digital Product and acknowledge that you cannot rely on any verbal or written representations not included in the official product description.

8.1 All Digital Products sold by Psychostrategist are protected by copyright and other intellectual property laws.

8.2 You are granted a non-exclusive, non-transferable license to use the Digital Product for personal, non-commercial purposes only.

8.3 Any unauthorized reproduction, distribution, or resale of our Digital Products is strictly prohibited and may result in legal action.

9.1 To the fullest extent permitted by applicable law, Psychostrategist shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use our Digital Products.

9.2 In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or using our Digital Products.

10.1 These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

10.2 Any dispute arising out of or relating to these Terms or your use of our Digital Products shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

We reserve the right to modify these Terms at any time, effective upon posting of an updated version on our website. Continued use of our services after any such changes shall constitute your consent to such changes.
